1. ACCEPTANCE OF TERMS

Welcome to buildr ("we," "us," "our," or the "Company"). These Terms of Service and Conditions ("Terms") constitute a legally binding agreement between you ("you" or "user") and buildr, Inc., a corporation organized under the laws of the State of Delaware, with its principal place of business at 447 Broadway, 2nd Floor #1342, New York, NY 10013, United States.

By downloading, installing, accessing, or using the buildr mobile application ("App"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not download, install, access, or use the App.

1.1 Modification of Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms in the App and updating the "Last Updated" date. Your continued use of the App after any changes indicates your acceptance of the modified Terms.

1.2 Additional Terms

Your use of the App is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Additionally, your use of the App through Apple's App Store or Google Play Store is subject to their respective terms and conditions.

2. ELIGIBILITY AND ACCOUNT REGISTRATION

2.1 Age Requirements

You must be at least 13 years of age to use the App. If you are under 18 years of age, you must have your parent or legal guardian's permission to use the App and agree to these Terms.

Special Notice for Children Under 13: The App is not directed to children under 13. We do not knowingly collect personal information from children under 13. If we discover that a child under 13 has provided us with personal information, we will promptly delete such information.

2.2 Account Creation

To access certain features of the App, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and accept all risks of unauthorized access
  • Notify us immediately if you discover or suspect any security breaches
  • Take responsibility for all activities that occur under your account

2.3 Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to violation of these Terms, fraudulent or illegal activity, or extended periods of inactivity.

3. SUBSCRIPTION SERVICES

3.1 Subscription Plans

buildr offers subscription services on a monthly and annual basis ("Subscription Services"). By purchasing a subscription, you agree to pay the applicable fees for your selected subscription plan.

3.2 Billing and Payment

3.2.1 Payment Processing

Web Billing: All subscription purchases are processed through our web-based billing system managed by RevenueCat and powered by Stripe, our payment processor. By subscribing, you agree to RevenueCat's and Stripe's terms of service and privacy policies.

Payment Methods: We accept major credit cards, debit cards, and other payment methods as available through Stripe.

Billing Information: You agree to provide current, complete, and accurate billing information. You agree to promptly update your billing information if it changes.

Authorization: By providing your payment information, you authorize us to charge your payment method for all subscription fees and applicable taxes.

3.2.2 Subscription Terms

  • Subscriptions automatically renew unless canceled before the end of the current billing period
  • You will be charged no earlier than 24 hours before the beginning of each billing period
  • Subscription fees are non-refundable except as required by law or as set forth in the applicable app store's refund policy

3.3 Price Changes

We reserve the right to change subscription prices. We will provide at least 30 days' advance notice of price increases. The new price will apply to your next billing cycle after the notice period. If you do not wish to pay the increased price, you may cancel your subscription before the price change takes effect.

3.4 Free Trials

We may offer free trial subscriptions. Unless you cancel before the end of the free trial period, you will be automatically charged the applicable subscription fee at the end of the trial.

3.5 Cancellation

You may cancel your subscription at any time through your account management portal at [your subscription portal URL]. Cancellation will take effect at the end of the current billing period. You will continue to have access to the Subscription Services until the end of your paid period.

To cancel your subscription:

  1. Log into your account at [your subscription portal URL]
  2. Navigate to "Subscription Settings"
  3. Click "Cancel Subscription"
  4. Follow the prompts to confirm cancellation

You will receive an email confirmation of your cancellation.

3.6 Refund Policy

3.6.1 General Policy

buildr operates on a no-refund policy for subscription fees already paid, except as described below. When you cancel your subscription, you will continue to have access to the Subscription Services until the end of your current paid period.

3.6.2 Eligible Refund Scenarios

We may provide refunds at our sole discretion in the following circumstances:

  • Technical Issues: If you experience persistent technical problems that prevent you from accessing the App's core features, and we are unable to resolve them within a reasonable timeframe
  • Duplicate Charges: If you were accidentally charged multiple times for the same subscription period
  • Unauthorized Charges: If charges were made to your account without your authorization
  • Early Cancellation of Annual Plans: If you cancel an annual subscription within 14 days of purchase and have not substantially used the services

3.6.3 Refund Request Process

To request a refund:

  1. Contact our support team at support@buildr.io within 30 days of the charge
  2. Include your account email, transaction details, and reason for the refund request
  3. Allow up to 7 business days for review of your request

3.6.4 Refund Timing

If approved, refunds will be processed within 5-10 business days. The refund will be credited to your original payment method. Please note that your bank or credit card company may take additional time to post the refund to your account.

3.6.5 Refund Restrictions

  • No refunds will be provided for partial subscription periods (except as noted above)
  • Users who repeatedly request refunds may be flagged for potential abuse
  • We reserve the right to refuse refunds if we detect fraudulent activity

3.7 Payment Security

3.7.1 Secure Payment Processing

Your payment security is our priority. All payment transactions are processed through Stripe, a PCI Service Provider Level 1 certified payment processor—the highest level of certification available in the payments industry. This means:

  • Your payment information is encrypted using industry-standard TLS (Transport Layer Security)
  • Card details are transmitted directly to Stripe's PCI-compliant servers without passing through our systems
  • We do not store your full credit card numbers or security codes

3.7.2 Security Standards

Our payment infrastructure meets or exceeds:

  • PCI DSS (Payment Card Industry Data Security Standard) requirements
  • SOC 1 and SOC 2 compliance standards
  • Global financial industry security requirements

3.7.3 Fraud Protection

Stripe employs advanced machine learning algorithms to detect and prevent fraudulent transactions, protecting both you and buildr from unauthorized charges.

3.8 Account Management Portal

3.8.1 Self-Service Portal

You can manage your subscription and account settings through our customer portal at [your subscription portal URL]. Through this portal, you can:

  • View and update your payment information
  • Change your subscription plan
  • Download invoices and payment history
  • Cancel your subscription
  • Update your billing address
  • Manage your account preferences

3.8.2 Account Deletion

You have the right to delete your account at any time through the customer portal. Account deletion will:

  • Cancel any active subscriptions immediately
  • Remove your personal information from our active databases (subject to legal retention requirements)
  • Permanently delete your user-generated content
  • Be irreversible once confirmed

Please note that we may retain certain information as required by law or for legitimate business purposes (such as fraud prevention).
